TERMS AND CONDITIONS OF SALE
These Terms and Conditions of Sale (hereinafter the “Terms and Conditions”) apply to all purchases made by any internet user / individual (hereinafter the “CLIENT”) on the website www.ORIGINALHAPPYPEOPLE.com (hereinafter the “SITE”) from Lydie HUREL, registered under company number SIRET 40146004300037.

Any order placed on the SITE implies full and unconditional acceptance of these Terms and Conditions by the CLIENT.

“CLIENT”: the contracting party of the SELLER, acting as a consumer as defined by French law and jurisprudence, outside any professional or commercial activity.
“DELIVERY”: the first presentation of the PRODUCTS ordered by the CLIENT at the delivery address provided at checkout.
“PRODUCTS”: all products available for sale on the SITE.
ARTICLE 2 – Purpose
These Terms and Conditions govern the sale of PRODUCTS by the SELLER to the CLIENT.
The CLIENT is informed and acknowledges that the SITE is intended for consumers only. Professionals must contact the SELLER to obtain separate contractual conditions.

The CLIENT agrees to read these Terms and Conditions carefully and accept them before placing an order.
They are accessible at the bottom of every page of the SITE via a link and should be reviewed before ordering.
The CLIENT is advised to download, print, and retain a copy of these Terms.
By clicking the first order confirmation button and then the final validation button, the CLIENT acknowledges having read, understood, and fully accepted these Terms without restriction.
ARTICLE 4 – Purchasing Conditions
To purchase a PRODUCT, the CLIENT must be at least 18 years old and legally capable, or if a minor, must provide parental or legal guardian consent.
The CLIENT must provide accurate, complete, and up-to-date information. The SELLER reserves the right to request identity verification or validation of provided information.
ARTICLE 5 – Orders
5.1 Product Characteristics
The SELLER presents the essential characteristics of PRODUCTS on the SITE, in accordance with applicable law.
The CLIENT must review this information before placing an order.
Unless otherwise stated, all PRODUCTS are new and comply with applicable European and French regulations.
5.2 Order Process
Orders are placed directly on the SITE.
5.2.1 Product Selection
The CLIENT selects PRODUCTS, quantities, and options, then adds them to the shopping cart.
5.2.2 Order Validation
The CLIENT reviews the cart, logs in or registers, and confirms billing and delivery details, including price and taxes.
Payment is then completed following instructions on the SITE.
5.2.3 Order Confirmation
An order confirmation is displayed on the SITE and sent by email.
No postal or fax confirmation will be sent.
5.2.4 Invoicing
Billing and delivery details must be completed accurately.
Invoices are included inside the parcel upon delivery.
5.3 Order Date
The order date corresponds to the date of online confirmation by the SELLER.
5.4 Pricing
Prices are shown excluding VAT and may include delivery fees depending on location and carrier.
Prices may change at any time but the applicable price is the one displayed at the time of order.
5.5 Product Availability
Availability is indicated on the SITE.
If a PRODUCT becomes unavailable after ordering, the CLIENT will be informed promptly.
The CLIENT may choose:
- to wait for restock,
- to receive partial shipment,
- or to accept an alternative product.
Refunds are issued within 30 days if the order is cancelled due to unavailability.
ARTICLE 6 – Right of Withdrawal
The CLIENT has the right to withdraw from the purchase within 14 days of receiving the PRODUCT, without justification.

ARTICLE 7 – Payment
Payment is made online via methods offered on the SITE.
The CLIENT guarantees authorization to use the selected payment method.
Payment is debited upon order confirmation.
In case of payment failure, the order will be cancelled.
ARTICLE 8 – Proof & Archiving
Orders above €120 are archived for 10 years in accordance with French law.
The SELLER may provide copies upon request.
ARTICLE 9 – Ownership Transfer
Ownership remains with the SELLER until full payment is received.
Risk transfers upon delivery to the CLIENT.
ARTICLE 10 – Delivery
Products are shipped by the manufacturer or logistics partners.
Delivery times depend on production and shipping conditions.
International delivery may be subject to customs fees not covered by the SELLER.
ARTICLE 11 – Packaging
Products are carefully packaged according to transport standards.
The CLIENT must follow the same standards when returning items.
ARTICLE 12 – Guarantees
The SELLER is responsible for legal conformity and hidden defects in accordance with French law.
Clients may request repair, replacement, or refund under applicable conditions.
ARTICLE 13 – Liability
The SELLER is not responsible for misuse of the SITE or force majeure events.

In case of dispute, French courts have jurisdiction.
Prior to legal action, parties will attempt amicable resolution through mediation.
